1. Introduction & Acceptance

Welcome to Activewebzone ("Company", "We", "Our", or "Us"), accessible via activewebzone.in. These Terms and Conditions govern your access to and use of our website, services, and custom software development solutions.

By accessing our website, hiring our services, or purchasing software solutions (including AI Integrations, Web Applications, Mobile Applications, MLM Software, or Custom ERP Systems), you agree to be bound by these terms. If you do not agree with any part of these terms, please do not use our services.

2. Scope of IT & Software Services

Activewebzone delivers end-to-end custom technology and development services, including but not limited to:

• Custom Web Development (PHP, React, Node.js, Laravel, E-Commerce).
• Mobile Application Development (Android, iOS, Flutter cross-platform).
• Multi-Level Marketing (MLM) Platforms (Binary, Matrix, Unilevel, Generation plans).
• Enterprise Resource Planning (ERP) Systems (School, Hospital, Billing & Stock CRM).
• Artificial Intelligence (AI) Chatbots, LLM Integrations & Business Automation.
• Digital Marketing, Search Engine Optimization (SEO), and Hosting Support.

3. Payments, Billing & Billing Gateways

• Milestone Payments: Client agrees to pay advance payments and milestone installments as outlined in the initial project quotation or invoice.
• Payment Gateways: Payments processed online via integrated gateways (UPI, Cards, NetBanking, Razorpay, PayU, Stripe, etc.) are encrypted and secure.
• Currency & Taxes: All pricing quoted is in INR (₹) or USD ($) depending on client region, exclusive of applicable statutory taxes unless stated otherwise.
• Late Payments: Delays in project payments exceeding 7 business days may result in temporary suspension of project development, staging server access, or code deployment.

4. Intellectual Property & Code Ownership

Upon 100% full payment settlement for custom-developed projects, the client receives source code ownership rights for their project's custom logic and design.

Activewebzone retains ownership of pre-existing core frameworks, proprietary libraries, third-party plugin integrations, and reusable modules developed prior to or independently of the client contract.

5. Client Responsibilities & Data Usage

Clients are solely responsible for providing accurate project requirements, content, logo graphics, images, legal credentials, and third-party API keys required for development.

Activewebzone is not responsible for legal compliance issues arising from client content, MLM business rules, or misuse of software deployed on client domain servers.

6. Limitation of Liability

In no event shall Activewebzone or its developers be liable for indirect, incidental, consequential, or punitive damages (including loss of business profits, data corruption, domain server downtime, or third-party service outages) exceeding the amount paid by the client for the specific service rendered.

7. Technical Support & Warranties

We offer a standard 30 to 90 days free technical support period post-delivery for bug fixes related to original project scope.

Any modifications requested after project approval or beyond the initial scope will be treated as paid change-requests billed at our standard hourly or fixed rates.

8. Governing Law & Jurisdiction

These terms shall be governed by and construed in accordance with the laws of India. Any legal disputes arising out of these terms or services shall be subject to exclusive jurisdiction of courts located in Berhampur, Odisha, India.
